Introduction
1. This Standard Tender Document has been prepared for use by public
entities in Kenya 2. The following general directions should be observed when using the
document.
a) Specific details should be furnished in the Invitation to Tender
and in the special conditions of contract. The final documents to
be provided to the tenderers should not have blank spaces or give
options b) The Instructions to Tenderers and the general conditions of
contract should remain unchanged. Any necessary amendments to
these parts should be made through the special conditions of
contract and the appendix to instructions to tenderers. 3. (a) Information contained in the Invitation to Tender shall conform to
the data and information in the tender documents to enable potential
tenderers to decide whether or not to participate and shall indicate
any important tender requirements. (b) The Invitation to tender shall be issued as an advertisement in
accordance with the regulations or a letter of invitation addressed to
tenderers who have expressed interest following the invitation for
expression of interest for which the invitation is issued. SECTION I INVITATION TO TENDER
TENDER REF NO: UOK/T/007/2017/2018 TENDER NAME: SUPPLY AND DELIVERY OF LIBRARY BOOKS. 1. The University of Kabianga invites sealed bids from eligible
candidates for supply and delivery of Library books.
2. Interested eligible candidates may obtain further information from and
inspect the tender documents at University of Kabianga, Procurement
department main campus P.o Box 2030-20200 Kericho during normal
working hours from Monday to Friday 8.00 a.m to 5.00 p.m. 3. A complete set of tender documents may be obtained by interested
candidates upon payment of non-refundable fees of Ksh 1000 at Co-
operative Bank of Kenya, Kericho Branch A/C No:01129046214700 and
thereafter obtaining an official receipt from cash office OR download
the document for free from University website www.kabianga.ac.ke or
IFMIS portal and at www.suppliers.treasury.go.ke
4. Bidders who have downloaded the Tender documents from the website free
of charge shall immediately email their contact details; cell phone
number, email and company name to purchasing@kabianga.ac.ke for
records and communication of any tender clarifications and addenda.
5. Completed tender documents are to be enclosed in plain sealed
envelopes marked with tender reference number and be deposited in the
Tender Box at Procurement office or be addressed to University of
Kabianga so as to be received on or before 5th September 2017 AT
9.00A.M. 6. Prices quoted should be net inclusive of all taxes and applicable
duties delivery cost and other incidental expenses must be in Kenya
Shillings and shall remain valid for 12months from the date of
opening the tender. No variation will be allowed before the said
period. 7. Tenders will be opened immediately thereafter in the presence of the
Candidates or their representatives who choose to attend at University
of Kabianga Board room.

SECTION II - INSTRUCTIONS TO TENDERERS 2.1 Eligible Tenderers 2.1.1 A Tenderer is eligible to bid for a contract in procurement or an
asset if the person satisfies the following criteria a) The Tenderer has the legal capacity to enter into a contract
for procurement or asset disposal; b) The Tenderer is not insolvent, in receivership, bankrupt or in the
process of being would up ; c) The Tenderer , if a member of regulated profession, has satisfied
all the professional requirements; d) The procuring entity is not precluded from entering into the
contract with the person under section 55 of the Act. e) The Tenderer and his or her sub-contractor, if any, is not debarred
from participating in procurement proceedings under section 41 of
the Act; f) The Tenderer has fulfilled tax obligations; g) The Tenderer has not been convicted of corrupt or fraudulent
practices and h) Is not guilty of any serious violation of fair employment laws and
practices. i) The Tenderer or consortium shall be considered ineligible to bid
where incase of corporation, private company, partnership or other
body, the person or consortium, their spouse, child or sub-
contractor has substantial or controlling interest. j) A state organ or public entity shall require a person or a tenderer
to provide evidence that the criteria are satisfied.
2.1.2 Tenderers shall provide the qualification information statement that
the tenderer (including all members of a joint venture and
subcontractors) is not associated, or have been associated in the
past, directly or indirectly, with a firm or any of its affiliates
which have been engaged by the University of Kabianga to provide
consulting services for the preparation of the design, specifications,
and other documents to be used for the procurement of the goods under
this Invitation for tenders. i. Person has the legal capacity to enter into contract for
procurement or disposal. ii. The tenderer is not debarred from participating in procurement
proceedings. iii. The tenderer has fulfilled tax obligations iv. The tenderer has not been convicted of corrupt or fraudulent
practices. 2.1.3 Tenderers shall not be under a declaration of ineligibility for
corrupt and fraudulent practices. 2.2 Eligible Goods 2.2.1 All goods to be supplied under the contract shall have their
origin in eligible source countries. 2.2.2 For purposes of this clause, "origin" means the place where the
goods are mined, grown, or produced. Goods are produced when, through
manufacturing, processing, or substantial and major assembly of components, a commercially-recognized product results that is
substantially different in basic characteristics or in purpose or
